Facts:

Appellant former husband sought review of an order of the Circuit Court, which entered an equitable distribution award under Va. Code Ann. § 20-107.3 after 21 days elapsed from entry of the divorce decree and specifically reserved the right to retain jurisdiction to do so in the decree. The circuit court also did not honor the terms of a partial property settlement agreement between appellant and appellee former wife.

The Virginia Court made the following holding:
  • Under laws, Va. Code Ann. § 20-107.3, the court is not empowered to make an award of equitable distribution unless requested to do so by either party. Therefore, two prerequisites must be satisfied before the court can make an award of equitable distribution: (1) the court must decree a divorce; and (2) must also have before it a request by either party to make an award of equitable distribution.
  • There is nothing in the wording of Va. Code Ann. § 20-107.3(A) to prevent a court from exercises that part of its subject matter jurisdiction that deals with the divorce while reserving its jurisdiction over equitable distribution.
